¿Porqué Evo Es Un Delincuente?

La rere elección de Evo, es inconstitucional y quienes dieron la venia para que vaya como candidato, saben que cometieron un delito. Por eso es que están haciendo una gran campaña para que Evo gane esta ilegítima e ilegal rere elección.

Este año Evo Morales se ha dedicado a convencernos a todos de que está bien que vaya a una rere elección. Ha dicho que no hay otro candidato que ofrezca algo bueno. García Linera ha dicho que el MAS (Movimiento al Socialismo, partido de Evo y García), es el único que tiene ideas y que todo lo que Bolivia quiere lo están haciendo ellos.

Si esto es así, yo vivo en otro país. Vivo en el país en el que falta un año para las elecciones, y todos los candidatos que tenían un rol político relevante, han sido sometidos a la tortura judicial, a la persecución criminal, a la infamia, a la muerte civil y el confinamiento, en expresa contravención al Artículo 118 de la Constitución Política del Estado que dice: “Está prohibida la infamia, la muerte civil y el confinamiento”. Ir contra este artículo de la Constitución, convierte a todos los ministros en delincuentes.

Vivo en un país que ha leído la Constitución y que sabe que existen los siguientes artículos que prueban que Evo comete un delito de cohecho al comprar a los jueces del Tribunal Constitucional para que avalen su ilegal y delincuencial candidatura. La CPE se constituye en prueba de que nos gobiernan delincuentes que no la respetan, y la violan cuando les parece. Aquí les paso las pruebas:

PRIMERA PRUEBA
Art. 168. El periodo de mandato de la Presidenta o del Presidente y de la Vicepresidenta o del Vicepresidente del Estado es de cinco años, y pueden ser reelectas o reelectos POR UNA SOLA VEZ DE MANERA CONTINUA (Mayúsculas agregadas).

No dice expresamente que la renuncia de un presidente haga desaparecer su mandato, así que ir contra el tenor de este artículo solo porque Evo renunció a pocos días de cumplirse el tiempo de su segundo mandato, es poco ético, deshonesto, pero sobre todo, es ser un delincuente que va en contra de la Constitución.

SEGUNDA PRUEBA
Quinta Parte
PRIMACÍA Y REFORMA DE LA CONSTITUCIÓN
Artículo 410.
I. Todas las personas, naturales y jurídicas, así como los órganos públicos, funciones públicas e instituciones, se encuentran sometidos a la presente Constitución.
II. La Constitución es la norma suprema del ordenamiento jurídico boliviano y goza de primacía frente a cualquier otra disposición normativa. El bloque de constitucionalidad está integrado por los Tratados y Convenios internacionales en materia de Derechos Humanos y las normas de Derecho Comunitario, ratificados por el país. La aplicación de las normas jurídicas se regirá por la siguiente jerarquía, de acuerdo a las competencias de las entidades territoriales:
1. Constitución Política del Estado.
2. Los tratados internacionales.
3. Las leyes nacionales, los estatutos autonómicos, las cartas orgánicas y el resto de legislación departamental, municipal e indígena.
4. Los decretos, reglamentos y demás resoluciones emanadas de los órganos ejecutivos correspondientes.

Evo Morales sacó una ley que le da permiso para ir a una segunda re elección, pero este artículo señala que una ley no puede habilitarlo, pues está en contra de la CPE. Es un acto de delincuencia ir contra la CPE.

TERCERA PRUEBA
DISPOSICIONES TRANSITORIAS
Primera.
II. Los mandatos anteriores a la vigencia de esta Constitución serán tomados en cuenta a los efectos del cómputo de los nuevos periodos de funciones.

Los mandatos anteriores a esta Constitución se toman en cuenta a efecto de cómputo de los nuevos períodos de funciones. Pícaros, el presidente y vicepresidente renunciaron y pensaron que así, eludían esta disposición transitoria.
Existe el video donde Evo renuncia expresamente a volver a candidatear, para que se viabilice la firma de la Nueva Constitución.
Pero era un vil engaño. El siempre supo que iba a comprar al Tribunal Constitucional, al regalarles sus cargos a pesar de la negativa rotunda de la población que votó en 80% de votos Nulos y Blancos para evitar que ese Tribunal Constitucional sea posesionado.
Ir en contra de la Ley más grande que tenemos los bolivianos, y con absurda maña salirse con la suya, convierte a Evo Morales y Alvaro Garcia, en delincuentes comunes.

CUARTA PRUEBA
Artículo 196.
I. El Tribunal Constitucional Plurinacional vela por la supremacía de la Constitución, ejerce el control de constitucionalidad, y precautela el respeto y la vigencia de los derechos y las garantías constitucionales.
II. En su función interpretativa, el Tribunal Constitucional Plurinacional aplicará como criterio de interpretación, con preferencia, la voluntad del constituyente, de acuerdo con sus documentos, actas y resoluciones, así como el tenor literal del texto.

El inciso II solo acepta la interpretación literal y da preferencia a la voluntad del constituyente. La gravedad de la situación que se pasó, y las palabras de Evo Morales específicamente renunciando a una nueva reelección, y la prohibición de candidatura para Evo Morales que viabilizó esta nueva Constitución, son claves para determinar que los jueces constitucionales han cometido un delito.

De acuerdo a principios básicos de Derecho Constitucional, cualquier alumno de primero les dirá a los jueces del Tribunal Constitucional que han cometido un delito al hacer valer una ley que pasó el ejecutivo, sobre toda una Constitución.

A pesar de todas estas pruebas, Evo Morales ha sido proclamado como candidato presidencial del partido Movimiento al Socialismo, de manera ilegal e ilegitima.

Algunos malos bolivianos, lo secundan y se ríen de la ingenuidad de los políticos de oposición que pensaron que una Constitución podía hacer que salga un dictador de su puesto. Pero no han tomado en cuenta que hay millones de Buenos Bolivianos que no aceptamos que nos gobierne un delincuente, y no aceptamos las disposiciones de un Tribunal Constitucional ilegal e ilegítimo porque fue puesto a dedo por el que hoy se beneficia de sus actos.

Somos Muchos. Somos Buenos. Somos Bolivianos. Y no queremos que otra vez nos gobierne, quien se burla de todas las leyes, incluyendo nuestra Constitución Política del Estado. Para definir a un dictador, en este nuevo siglo, no solo están sus muertos, sino también sus actos. Su compra de todos los poderes para atornillarse en el poder, convierten a Evo Morales y Alvaro Garcia Linera en los delincuentes mejor pagados de la historia.

Que pena

Que pena me da leer estas palabras.
Tengo que admitir que fui de esas personas que confió plenamente en Evo, que se alegró al ver un indígena en el poder, que volvió a creer que había posibilidad de que el pueblo y no solo la élite podía llegar al poder. Vi "Cocalero" y quedé aún más fascinada y conmovida....me pareció un hombre tan sencillo, tan conectado a sus raíces, su gente, su pueblo y tan sabio. Es por eso que me da pena ver que el poder se le sube a la cabeza a mucha gente. No es el primero ni va a ser el último, pero aún así, me pesa en el corazón ver que esta gente en la que colocamos tanta esperanza, nos falla igual que los políticos de siempre.

Gracias por compartir tu sentimiento aquí. Yo también sentía lo mismo al principio del gobierno de Evo Morales. Pero cuando comenzó a matar y a propinar palizas y tortura judicial a quienes se le oponían, ya me di cuenta que nada bueno podía salir de su ansia de poder ilimitado y desenfrenado.

Hoy, me pregunto si el mundo se ha dado cuenta también, de que estos delitos son INACEPTABLES.

“Why Is Evo a Criminal?”

The re-election of Evo is unconstitutional and those who gave him the permission to move forward as a candidate have committed a crime. That is why they are making a big campaign so Evo can win this illegitimate and illegal election.

I live in the country where elections have been postponed a year, where all candidates who had an important political role have been subjected to judicial torture, criminal prosecution, public shame, termination of civil rights, and confinement—all of this in explicit violation of Article 118 of the State Constitution, which states: “Public shame, termination of civil rights, and confinement are prohibited.” Going against this article of the constitution makes all government ministers criminals.

I live in a country that has read the constitution. We know that the following articles exist and that they prove that Evo is committing a crime in bribing the judges of the constitutional court so they accept his illegal candidacy. The CPE (State Constitution) provides us with evidence that we are governed by criminals who utilize and violate the law as they see fit. Here is the evidence:

FIRST PIECE OF EVIDENCE:
Article 168
The term of the president and the vice president is set at five years, and may be reelected ONCE FOLLOWING THE FIRST TERM (uppercase mine).

It does not explicitly state that a resignation invalidates a term, however doing so goes against the spirit of this article. Evo resigned a few days before fulfilling his second term. This move is unethical, dishonest, and above all it goes against the constitution.

SECOND PIECE OF EVIDENCE:
Fifth Part
SUPREMACY AND CONSTITUTIONAL REFORM
Article 410
I. All persons and corporations, as well as public bodies, public authorities, and institutions, are subject to this constitution.
II. The constitution is the supreme law of the Bolivian legal system and takes precedence over any other legal provision. The constitutionality block consists of international treaties and conventions on human rights and rules of community law ratified by the country. The application of legal rules is governed by the following hierarchy, according to the powers of local authorities:
• State Constitution
• International Treaties
• National laws, autonomy statutes, charters, and other departmental, municipal, and indigenous laws
• Decrees, regulations, and other resolutions issued by corresponding executive bodies

Evo Morales utilized a law to give himself permission to seek a third term, but this article points out that laws cannot enable it. It is against the CPE, and going against the CPE is a criminal offense.

THIRD PIECE OF EVIDENCE
TRANSITIONAL PROVISIONS

III. Terms prior to the effective date of this constitution will be taken into account in order to calculate the period of new positions.

The president and vice president resigned and thought they would be able to circumvent this transitional provision.

There is a video in which Evo explicitly states he will not seek candidacy again as he approves his signature to the new constitution. But this was a lie. He always knew he was going to bribe the constitutional court, despite the staunch refusal of the population (80% of votes) that voted against it.

Craftily sidestepping the greatest law that we Bolivians have, make Evo Morales and Álvaro García common criminals.

FOURTH PIECE OF EVIDENCE
Article 196
I. The Plurinational Constitutional Court ensures the supremacy of the constitution, determines constitutionality, and demands respect and observance of constitutional rights and guarantees.
II. In its interpretive function, the Plurinational Constitutional Court will be applied as a criterion of interpretation to the will of the constituent with accordance to its documents, acts, and resolutions, as well as the meaning of the text itself.

Subsection two is only interpreted literally, and gives preference to the will of the constituent. The constitutional judges have committed a crime, and to arrive at this conclusion we must consider the following: the seriousness of what has happened, Evo Morales’s words specifically denouncing a new election, and the prohibition on Morales’s candidacy who in turn brought the new constitution into law.

According to the basic principals of constitutional law, any student can tell the judges of the Constitutional Court that they have committed a crime, against the constitution, in enforcing a law passed by the executive.

In spite of all of this proof, Evo Morales has been illegally and illegitimately proclaimed the presidential candidate for Movement for Socialism Party.

Some bad Bolivians support him and laugh at the naïveté of the opposition politicians who thought a Constitution could remove a dictator from office. But they did not take into account the millions of good Bolivians who do not accept a criminal as a leader. We do not accept the provisions of an illegal and illegitimate Constitutional Court because it was taken advantage of by someone who now enjoys its benefits.

We are many. We are good. We are Bolivian. And we do not want him to rule over us anymore, he who makes a mockery of all our laws, including out State Constitution. To define a dictator in this new century, there is not only the dead, but also actions. Buying over all to install themselves in power have turned Evo Morales and Álvaro García Linera into the best paid criminals in history.

Gracias por compartir su artículo. Yo creo que en los Estados Unidos, no han entendido mucho sobre la situación actual en Bolivia. Sí reconocemos que Evo Morales está en poder, pero sus actos no destacan mucho en la consciencia pública. Por eso, me siento agradecido (no conozco la palabra exacta) por leer este artículo y ahora pienso que tengo una mejor comprensión de lo que pasa en Bolivia y de lo que piensan los bolivianos.
