Si vous êtes victime (ou témoin) de harcèlement sexuel

Vous pouvez vous adresser :
aux représentants du personnel de votre entreprise, si elle en dispose
à une association spécialisée, dont l'objet est de combattre les discriminations fondées sur le sexe ou les moeurs (voir pages ressources)
à l'inspecteur du travail qui peut dresser procès-verbal s'il constate une mesure discriminatoire. Contactez la DDTEFP (Direction Départementale du Travail, de l'Emploi et de la Formation Professionnelle) de votre département.

Vous pouvez engager une action en justice

Vous pouvez porter le litige devant :
le conseil des prud'hommes compétent pour un litige avec votre employeur relativement à l'exécution ou à la rupture de votre contrat de travail (ex. refus de promotion licenciement abusif)
le tribunal de grande instance, qui siégeant dans sa formation correctionnelle, peut prononcer des sanctions pénales à l'encontre de l'employeur, ou de la personne qui a abusé de son autorité. Le tribunal de grande instance est également compétent pour les faits de harcèlement sexuel intervenant dans le cadre d'un recrutement ou ayant pour auteur un client de l'entreprise. Vous devez avoir un avocat pour saisir le tribunal de grande instance. Si vous souhaitez vous voir accorder des dommages et intérêts en réparation du préjudice subi, vous devez vous constituer partie civile.

Une organisation syndicale ou une association peut agir en votre nom

En donnant votre accord écrit à une
organisation syndicale, celle-ci peut
engager une procédure devant le
conseil des prud'hommes et, éventuellement,
se porter partie civile (à son profit toutefois,
non au vôtre) devant le juge pénal
Une association déclarée depuis
au moins 5 ans à la date des faits
et dont l'objet est de combattre les discriminations fondées sur le sexe ou les moeurs
peut agir devant la juridiction pénale
si elle justifie de votre accord écrit.
Elle peut aussi se constituer partie civile
(à son bénéfice, également).

Les preuves ...

Dans tous les cas, le juge appréciera la réalité et la gravité des faits au vu des preuves que vous pourrez fournir. Aussi importe-t-il de fournir tout élément de nature à convaincre le juge : documents, témoignages, etc.

You can begin an action of justice

You can bring the dispute to:

The competent tribunal for a dispute with your employer regarding the performance of the failure of your work contract (ex. Refusal of promotion or unfair dismissal). The high court, seated in the area of correctional training, can put penal sanctions against your employer or the person who abused their authority. The high court is also responsible for the incidences of sexual harassment that occur in terms of hiring or acquiring a client for a company. You must have a lawyer to enter the high court. If you wish receive damages in the interest of reparations based on prejudice, you must be part of a civil party.

A trade-union organization or an association that can act in your name:

In giving your written agreement to a union it can initiate the procedures before the Labor Court and eventually take part in a civil case (in its favor, however not yours) before a criminal judge. An association registered for five years from that date of the incident in which the objectives are to fight against discrimination based on gender and values can act before a criminal court, whether it has your written agreement. The union can also be part of a civil action (for their benefit as well).

In all cases, the judge will assess the reality and the severity of the cases in light of the evidence you provide. Also important is to provide any information, documents, or witnesses that might help to convince the judge.
