Sanction disciplinaire : la salarié qui commet un abus d'autorité en matière sexuelle est passible d'une sanction disciplinaire pronononcée par l'employeur. Celle-ci peut aller jusqu'au licenciement : en effet, l'employeur peut, par exemple, considérer que la dégradation des relations entre les salariés et les conséquences du harcèlement sur un(e) salarié(e) entravent la bonne marche de l'entreprise.

Sanction pénale : toute personne qui commet un abus d'autorité peut être poursuivie devant la juridiction pénale à l'initiative du Parquet. Comme en toute autre matière, la plainte peut être déposée directement auprès du Procureur de la République (par courrier), du commissariat de police ou de la gendarmerie de votre ressort, ou - ce qui est moins connu - du doyen des juges d'instruction du tribunal de grande instance (par courrier).
La peine encourue est l'emprisonnement pour une durée maximum de un an, assortie d'une amende d'un montant maximum de 100.000 FF.
Dommages et intérêts : l'auteur de harcèlement peut-être condamné par le juge à verser des dommages et intérêts. Leur montant varie selon le préjudice subi. Le versement de dommages et intérêts suppose que la victime se soit constituée partie civile à un moment ou un autre de la procédure.

Des relations sexuelles obtenues
par abus d'autorité peuvent être
pénalement qualifiées de viol
(crime jugé aux assises).

Protection des candidats à un emploi et des salariés victimes ou témoins

Les candidats à un emploi et les salariés sont protégés à l'occasion de l'embauche et tout au long de l'exécution du contrat de travail ainsi que lors de sa rupture.
La protection s'étend au salarié qui a subi ou refusé de subir un harcèlement sexuel, ainsi qu'à celui qui a témoigné de ces faits ou les a relatés.
Les garanties offertes sont les suivantes :
# nullité de toute sanction ou de tout licenciement prononcé à l'encontre du salarié
victime ou témoin de l'abus d'autorité ;
# interdiction de toute décision discriminatoire, aussi bien à l'embauche que pendant l'exécution ou lors de la rupture du contrat de travail

Penalties: Varied and…dissuasive?

The legislator has diversified and reinforced the penalties applicable to those committing sexual harassment.
Disciplinary sanction: the employee who commits abuse of authority in sexual matters is liable to disciplinary sanction by the employer. The sanction may go as far as lay-off: for example, an employer may consider that the damage to employee relationships and the consequences of the harassment of an employee (male of female) hinders the company’s success.

Criminal penalty: anyone committing abuse of authority may be prosecuted before the criminal court at the request of the Prosecutor. As in every other matter, the complaint may be filed directly to the Public Prosecutor (by mail), to the police station or to the police force of your jurisdiction, or –the lesser known option- to the chief examining magistrate of the Regional Court (by mail).

The penalty is imprisonment for a maximum period of one year, along with a maximum fine of 100.00 FF.

Damages: the perpetrator of the harassment may be ordered by the judge to pay damages to the victim. The total varies according to the harm suffered. The paying of damages entails that the victim sues for damages at any given moment throughout the procedure.

Sexual relations resulting from abuse of authority may be classified as rape (crime judged by an assizes judge). Refer to the section on this subject.

Protection of applicants for a job, and of victim and witness employees

Both applicants for a job and employees are protected upon hiring and throughout the work contract, as well as upon its completion. Protection extends to an employee who has suffered or refused to suffer sexual harassment, as well as to one having witnessed these events or recounted them.

The following is guaranteed:
• Nullity of any penalty or layoff against the employee (victim or witness of the abuse of authority)
• No decision made based on discrimination, either upon hiring and throughout the work contract, or at upon its completion

J’espère avoir bien traduit votre texte pour que d’autres personnes puissent connaitre la vraie justice. Moi, j’ai beaucoup appris, et c’est réconfortant de savoir que les sanctions sont maintenant plus imposées.
